Welcome to Social Cyclist, a service provided by Social Bicycles, Inc. ("SoBi") to solicit public input for the improvement of shared bicycle infrastructure and to report hazardous road conditions for the benefit of other Social Cyclists.
1. Information We Receive
We collect and use your information below to provide our Services and to deliver better services to all of our users over time.
A. Information You Provide Us Directly
You provide us with your full name, e-mail address and password when you register for a Social Cyclist account. You may provide information for your user profile (e.g. first and last name, picture). This information allows us to help you or others be "found" on Social Cyclist. You may provide us with user Content (e.g comments, photos, racks, routes, reports, and other materials) that you post to the Services. We may need to provide you with certain communications, such as account verification, service announcements and administrative messages. These communications are considered part of the Services and your Social Cyclist account, which you may not be able to opt-out from receiving.
Some personal information you may provide is always publicly available:
- Name: This helps your friends find you.
- Profile Picture: This helps your friends recognize you. If you are uncomfortable making this photo public, you can always delete it.
- User ID: This allows you to give out a custom link to your public Page.
B. Information Collected Automatically
Location Information: The Services collect your location and route information. SoBi uses that information to provide you and other users with the Services. Whenever you open, use or interact with Social Cyclist, SoBi uses the location information from your mobile device or browser to tailor the Social Cyclist experience to your current location. The Services also use your mobile devices 'background location' to provide you with optional notifications (e.g. letting you know when a friend is riding nearby). If you have 'background location' turned on, the Social Cyclist app will, from time to time, tell us about your device's location even if you are not directly interacting with the application.
Each of your routes, reports, and rack requests is saved to your "Ride History," which allows you to look back at all the Content you have submitted since you created your Social Cyclist account. You can delete any or all of your routes from the route details page on the Social Cyclist website and Social Cyclist app. If for some reason you ever decide to delete your Sociual Cyclsit account, your entire ride history will be removed from our database.
Sometimes you’ll want to ride without sharing your specific whereabouts with friends. This is why we created "Private rides" as a way of recording rides to your ride history, earning points and adding to your badge counts, while maintaining complete privacy (even from friends). To ride "privately", simply select "Private" on the "Share this ride" option seen at the end of every "ride" screen across our mobile apps. As noted under "How We Use Your Information", while your private rides will not be visible to the public or your friends, we may share the fact that such rides have occurred in an anonymous manner.
At all times you may opt out of location information services by uninstalling the Application, by using the Application's uninstall option, or by using the programs removal feature of your operating system. Following the uninstallation process, SoBi will not be able to collect any further location based information from you, or provide you with location based information about activities, people or places in your close vicinity.
If you wish to remove personally identifying details from SoBi's servers, please contact firstname.lastname@example.org with your request.
If you choose to invite someone to Social Cyclist through our "Invite friends" feature, you may select a person directly from the contacts list on your device and send an email from your personal account. You understand and agree that you are responsible for any charges that apply to communications sent from your device, and because this invitation is coming directly from your personal account, Social Cyclist does not have access to or control this communication.
Log File Information: Log file information is automatically reported by your browser each time you make a request to access (i.e., visit) a web page or app. It can also be provided when the content of the webpage or app is downloaded to your browser or device. When you use our Services, our servers automatically record certain log file information, including your web request, Internet Protocol ("IP") address, browser type, referring / exit pages and URLs, number of clicks and how you interact with links on the Service, domain names, landing pages, pages viewed, and other such information. We may also collect similar information from emails sent to our Users which then help us track which emails are opened and which links are clicked by recipients. The information allows for more accurate reporting and improvement of the Service.
Device Identifiers: When you use a mobile device like a tablet or phone to access Social Cyclist, we may access, collect, monitor, store on your device, and/or remotely store one or more "device identifiers." Device identifiers are small data files or similar data structures stored on or associated with your mobile device, which uniquely identify your mobile device. A device identifier may be data stored in connection with the device hardware, data stored in connection with the device's operating system or other software, or data sent to the device by the Services. A device identifier may deliver information to us or to a third party partner about how you browse and use the Service and may help us or others provide reports or personalized content and ads. Some features of the Services may not function properly if use or availability of device identifiers is impaired or disabled.
Metadata: Metadata is usually technical data that is associated with User Content. For example, Metadata can describe how, when and by whom a piece of User Content was collected and how that content is formatted. Users can add or may have Metadata added to their User Content including a hashtag (e.g., to mark keywords when you share a ride), geotag (e.g., to mark your location to a rack request), comments or other data. This makes your User Content more searchable by others and more interactive.

Personal Information about our users is an integral part of our business.
Publicly Available Information: When we use the phrase "public information" we mean the information you choose to make public, as well as information (e.g. rack requests and comments on racks) that is always publicly available. You may choose to make some of your information public. Choosing to make your information public also means this information: can be associated with you off Social Cyclist; can show up when someone does a search on Social Cyclist or a public search engine; will be accessible to anyone who uses our APIs. Except for information about you that may appear on your user profile, information that you provide to us as part of your registration is generally not visible to other Users or to non-users who visit the Site.
Friends: Your friends can see the route and time of each of your shared rides, your rack requests, comments on racks, reports, name, photo, badges, and links to your Twitter and Facebook accounts (if you have connected those accounts to your Social Cyclist account). Individuals reading this information may use it or disclose it to other individuals or entities without SoBi's control and without your knowledge. We therefore urge you to think carefully about including any specific information you may deem private in comments or other content that you create in the Services.
Agents: We employ other companies and people to perform tasks on our behalf and need to share your information with them to provide products or services to you. Our agents do not have any right to use Personal Information we share with them beyond what is necessary to assist us, and they provide a comparable level of protection for your Personal Information.
Improving Social Cyclist: We may also use personal information collected from you for the following general purposes: (1) to fulfill your requests for Services; (2) to improve our Services; (3) to contact you to resolve problems; (4) to send you information about Services including confirmations, technical notices, updates, security alerts, and support and administrative messages; (5) to communicate with you about products and services offered by us and our selected partners; (6) to conduct research; and (7) to make the Services easier to use by reducing the need for you to enter information. From time to time we may send newsletter emails, from which you may unsubscribe as provided for in the emails.
3. Information You Share
Social Cyclist is built around the idea of sharing information (e.g. routes, rack requests, reports, etc.) with others. Remember that when you share information publicly, it may be indexable by search engines. Social Cyclist provides you with different options on sharing, controlling the visibility of, and removing your content.
4. Modifying Your Personal Information
If you are a registered user of our Services, we provide you with tools and account settings to access or modify the personal information you provided to us and associated with your account. We will retain your information for as long as your account is active or as needed to provide you Services. You can also permanently delete your Social Cyclist account. If you choose to permanently delete your account, your account will be deactivated and then deleted. When your account is deactivated, it is not viewable on the Services. For up to 30 days after deactivation it is still possible to restore your account if it was accidentally or wrongfully deactivated. After 30 days, we begin the process of deleting your account from our systems, which can take up to a week.
If you wish to opt-out of receiving promotional emails from us, you must follow the instructions in any such promotional emails we send to you. If you opt-out, we may still send you non-promotional emails. You may not opt out completely of receiving email communications necessary for the operation of your user account unless you decide to terminate your account. If you no longer wish to use our Services, or receive any form of direct contact from SoBi or Social Cyclist,contact us.
Under California law, California residents who have an established business relationship with us may choose to opt-out of the disclosure of personal information about them to third parties for such third parties' direct marketing purposes. As detailed above, our policy is not to disclose personal information collected online to a third party for direct marketing purposes without your approval. 5. International Users
If you are located outside of the United States, please note that our Services are hosted on computer servers in the United States. Therefore, your information may be processed and stored in the United States. As a result, United States federal and state governments, courts, or law enforcement or regulatory agencies may be able to obtain disclosure of your information through laws applicable in the United States. Your use of this site or the Service or your submission of any Personal Information to us will constitute your consent to the transfer of your Personal Information outside of your home country, including the United States, which may provide for different data protection rules than in your country.
SoBi's complies with the U.S.-EU Safe Harbor Framework and the U.S.-Swiss Safe Harbor Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information from European Union member countries and Switzerland. SoBi has certified that it adheres to the Safe Harbor Privacy Principles of notice, choice, onward transfer, security, data integrity, access, and enforcement. 6. Children's Privacy
Our services are not directed to persons under 13 and SoBi does not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to create an account for the Services. If you are under 13, please do not attempt to register or send any information about yourself to us, including your name, address, telephone number, or email address. No one under the age of 13 may provide any personal information to us. In the event that we learn that we have collected personal information from a child under age 13 we will delete that information as quickly as possible. If you believe that we might have any information from or about a child under the age of 13, please contact us at firstname.lastname@example.org.
7. Information We Share
We may disclose your personal information in connection with a corporate transaction, proceeding, or reorganization involving the business activities for which the information is maintained. In the event that ownership of SoBi or its business was to change as a result of a merger, acquisition, or transfer to another company, your personal information may be transferred. If such a transfer results in a material change in the way your personal information is used, we will provide notice about the choices you have with respect to such a transfer.
We may disclose your personal information, including location/GPS data, in response to legal process (for example, a court order, search warrant, or subpoena) or requests from law enforcement authorities, in other circumstances in which we believe the Services are being or have been used in violation of the applicable law or otherwise in the commission of a crime, when we have a good faith belief that there is an emergency that poses a threat to the safety of you or another person, or when necessary to protect the rights or property of SoBi, our agents, customers, users, or other third parties.
In an ongoing effort to better understand and serve our Users, we may conduct research on our end user's demographics, trips, interests, and behavior based on the information provided to us. This research may be compiled and analyzed on an aggregate basis, and we may share this aggregated data with our affiliates, agents, and business partners. This aggregate information does not identify you personally. We may also disclose aggregated User statistics in order to describe our Services to current and prospective business partners and to other third parties for other lawful purposes.
8. Information Security
We work hard to protect SoBi, Social Cyclist, and our users from unauthorized access to or unauthorized alteration, disclosure or destruction of information we hold. We encrypt our Services using SSL. We review our information collection, storage nad processing practices to guard against unauthorized access to systems. We restrict access to personal information to SoBi employees, contractors, and agents who need to know that information in order to process it for us, and who are subject to strict contractual confidentiality obligations and may be disciplined or terminated if they fail to meet these obligations.
Please note that no data transmission over the Internet is 100% secure. As a result, we cannot guarantee that your personal information transmitted through our Services will be absolutely protected. For example, your personal information may be affected by actions outside of our control, such as computer "hacking" and physical theft. You acknowledge that you provide your personal information at your own risk. We use a password to help verify your identity before granting access to any of your personal information. It is your responsibility to safeguard your password, which you should never disclose to a third party.
